These Terms of Service apply to all photography, videography, digital content, image viewing, purchasing, and downloads provided by By Niamh.

By accessing this website, viewing galleries, purchasing images, or downloading content, you agree to the following terms.

1. COPYRIGHT & OWNERSHIP

All images, videos, and digital content created by By Niamh remain the copyright and intellectual property of By Niamh, unless otherwise agreed in writing.

Purchasing or downloading images does not transfer copyright ownership.

2. IMAGE USAGE & LICENSING

Personal Use

Images purchased or downloaded for personal use may be used for:

• Personal viewing

• Personal printing

• Personal social media sharing (with credit where possible)

Images must not be:

• Sold

• Used for commercial purposes

• Entered into competitions

• Submitted for publication

Without prior written permission.

Commercial Use

Commercial use (including brand promotion, advertising, websites, social media for business purposes, or resale) requires a separate licence and must be agreed in advance.

3. EDITING & IMAGE STYLE

All images are delivered in the photographer’s style and artistic judgement.

By purchasing images, you acknowledge that:

• Requests for additional edits may incur a fee

• Raw/unedited files are not supplied

4. EVENT PHOTOGRAPHY & GALLERIES

By attending an event where photography is taking place, you acknowledge that images may be captured and made available for purchase through this website.

It is the responsibility of the purchaser to ensure they have permission from all visible individuals (including parents/guardians for minors) before sharing images publicly.

5. PAYMENT & DOWNLOADS

• All sales are final once images have been downloaded

• No refunds are offered for digital products

• Images should be downloaded and backed up promptly

• By Niamh is not responsible for lost files once downloads have been completed

6. LIABILITY

By Niamh will take reasonable care in the delivery of services and digital products. However, liability is limited to the value of the purchased images or services.

By Niamh is not responsible for:

• Loss or damage caused by third-party platforms

• Website outages

• Client misuse of images

• Failure to download or back up purchased files

7. FORCE MAJEURE

By Niamh shall not be held liable for failure to deliver services due to events beyond reasonable control, including but not limited to weather conditions, venue restrictions, illness, or equipment failure.

8. GOVERNING LAW

These terms are governed by the laws of England and Wales.
